5. Use of The Site

6. Terms of Sale

6.1 Registration

  1. To place an Order, you must register with us by creating an account on the site. You must only submit to us information which is accurate and true. You must also keep your information up to date by informing us of any changes by using the relevant sections of the Site.
  2. You shall not misuse the site by creating multiple user accounts.

6.2 Price And Payment

  1. Whilst we make best efforts to ensure that all details, descriptions and prices which appear on this Site are accurate, there may be instances where errors may occur. If we discover an error in the price of any products which you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. If you cancel your order before we have shipped it to you, and you have already paid for your Order, you will receive a full refund.
  2. You (the “Buyer”) accept, declare and undertake that you have read the primary information regarding the basic qualities of the Product subject to the Contract, the sales price and the delivery on the Web Site, and that you have the necessary confirmation in the electronic environment.
  3. You can pay using any of our payment partners listed on our homepage or by using the cash on delivery payment method. Similarly, you can pay all or part of the price of your Order using an e-gift card, wallet credit or promotional voucher
  4. To minimize the risk of unauthorized access, we encrypt your card data. Once we receive your order, we will request pre-authorization on your card to ensure there are sufficient funds available to complete the transaction. Orders will not be confirmed until this pre-authorization check has been completed. Your card will be debited once we have sent you the order confirmation. Cards are subject to validation checks and authorization by the card issuer. If we do not receive the required authorization, we will not be liable for any delay or non-delivery.
  5. Upon authorization of the payment, by clicking the “Order now” button, you are confirming that the card belongs to you, or that you are the legitimate holder of the e-gift card or the promotional voucher, and have sufficient funds or credit facilities to cover the cost of the Product(s) ordered.
  6. Prices include VAT (where applicable).
  7. Depending on the value of your order, the delivery option or address you choose, delivery costs may also be charged. Such additional charges will be clearly shown during the checkout process and included in the “Total Cost”
  8. If you wish to cancel your Order, please contact our Customer Service Team by dropping us an email. No cancellation fees shall be applicable.
  9. You as the buyer accept, declare and undertake to be legally responsible and to pay interest for failing to meet your financial obligations within buying transactions, carried out via credit card, between us. In this case, both your Bank and us (the “Seller”) may take legal actions and you will have to compensate for any loss regarding this matter.

7. Delivery

  1. We aim to deliver the Product to you at the place of delivery requested by you and the time indicated by us in your order at the time of checkout (as updated in the order confirmation).
  2. We shall notify you if we expect to be unable to meet our estimated delivery date.
  3. The date of delivery specified by Us is an estimate only. Time for delivery shall not be of the essence of the contract.
  4. You shall make all arrangements necessary to take delivery of the Product whenever they are tendered for delivery.
  5. We deliver in our standard packaging.
  6. If you are not available to take delivery or collection, we may leave a card giving you instructions for re-delivery or collection from the carrier.

8. Returns And Refund Policy

  1. We undertake to fulfill our contractual obligations in compliance with the legal regulations and in good faith. We, as the Seller promise to provide your ordered Product in accordance with the Product descriptions stated in the Website.
  2. If you are not completely satisfied with your purchase, you may return the Product to us within fourteen (14) days of receipt. The Product shall be unused, Product tags shall not be tampered with, and the product shall be in the original brand packaging (if applicable). This policy is applicable only to those products which do not fall under the list of non-refundable brands/items provided on our Site.
  3. If the product becomes unobtainable after your order, we may provide you a different product with equal quality under the condition of informing you and having your explicit consent concerning the matter.
  4. You shall ensure that the Product is sent to us in the same condition as it was when received by you and is packaged properly. In the event that an item is returned to us in an unsuitable condition, we reserve the right to decline the return and send the product back to you.
  5. You, as the Buyer, are obliged to control the Products subject to the contract before receiving them; crushed, broken, unpackaged etc. Delivered Products will be deemed to be undamaged. Responsibility of damage of the Products after delivery will belong to you.
  6. We provide a prepaid return shipping service to ensure the best possible online shopping experience for you. Please refer to the prepaid shipping label in the parcel sent with your order. If you are unable to find the prepaid shipping label, please contact our Customer Service Team by dropping us an email.
  7. A refund shall be issued shortly after we receive your returned Products together with your return slip, according to the preferred refund method indicated on your return slip. For more details please refer to the FAQ (http://www.gotrend.com/faq-returns/) on the Site.
  8. If the item you receive is faulty, please contact our Customer Service Team and provide your Order number, your name and address, details of the Product and the reason for return, plus whether you require a refund or replacement.
  9. Your rights under this Terms will automatically terminate without notice if you fail to comply with any of its terms. In case of such termination, we may immediately revoke your access to our Website and Services.
  10. You have the right to withdraw from this contract within fourteen (14) days without giving any reason. The withdrawal period shall be fourteen (14) days from the date you, or a third party named by you, who is not the carrier, have/has taken possession of the Products, or, where your order contained multiple Products which will be delivered separately, delivery of the final Product(s) making up your order (“Withdrawal Period”). To meet the withdrawal period deadline you will need to notify us about the fact that you are exercising your right of withdrawal before the expiry of the withdrawal period. You must send back or submit the Products immediately after, but in any event no later than fourteen (14) days from the date on which you inform us about the withdrawal from the contract of sale. This deadline shall be deemed met if you send the Products before this deadline expires. If you withdraw from a contract of sale during the Withdrawal Period, we shall reimburse all payments we received from you, including delivery charges, at the latest within fourteen (14) days from the date on which the notification of withdrawal of this contract has been received by us. For this repayment we shall use the same method of payment that you used making the original transaction, unless we arrange a different method with you; you will not be charged any fees for such repayments under any circumstances. We may withhold reimbursement until we have received the returned Products, or until you have submitted proof that you have returned the Products, whichever comes earlier. You only have to pay for any diminished value of Products if this diminished value is due to improper handling on your behalf while ascertaining the nature, characteristics and functioning of the Products.

9. Vocuhers

  1. You may use promotional vouchers and e-gift cards to make payment for Products on the Site. Specific details for promotional vouchers and e-gift cards are listed below.
  2. If you have a gift or promotional voucher, that voucher can be used by someone other than yourself and you can assign your rights to use that voucher.
  3. Conditions for the redemption of promotional vouchers (From time to time we may distribute promotional vouchers, for use only on the Site, which we will send to you either by email or post.)
    • Promotional vouchers are valid for the specified period stated on the voucher, can only be redeemed once and may not be used in conjunction with other promotional vouchers and discounted items. We may exclude individual brands from voucher promotions in accordance with our sales strategies.
    • The credit of a promotional voucher does not accrue interest, nor does it have a cash value.
  4. Conditions for the redemption of e-gift cards:
    • You may purchase e-gift cards for use on the Site by you or other Customers. These e-gift cards will be sent via email.
    • E-gift cards cannot be used to buy further e-gift cards. E-gift cards may only be purchased through debit card, credit card.
    • The credit of an e-gift card does not accrue interest, nor does it have a cash value.
    • An order for an e-gift card can be cancelled by sending us an email.
    • If the credit of an e-gift card is insufficient for the Order you wish to make, you may make up the difference using one of our other accepted payment methods

10. Guarantee And Complaints Management

  1. GOTREND shall perform its obligations under these Terms and Conditions with reasonable skill and care.
  2. We place great value on our Customer satisfaction. You may contact us at any time using the contact details given in the site. We will attempt to address your concerns as soon as possible and will contact you on receipt of any relevant enquiry or complaint. In guarantee cases, the manufacturer is frequently involved and as such it may take longer to resolve such an enquiry or complaint.
  3. In the event of a complaint it will help us if you can describe the object of your complaint as accurately as possible and, where applicable, provide copies of the Order or at least the Order number that we assign you in your Order Confirmation. In rare cases your emails may be caught up in our spam filters or not reach us, or correspondence that we send to you may otherwise not have reached you. Should you not have received any response from us within five (5) Business Days, please make further enquiries.

11. Enforcement

After the payment of the Product, you will be deemed to have accepted all the Terms and Conditions. Our obligation here is to build a system on the Website to ensure that the order cannot be placed on the site without obtaining confirmation that it has been read and accepted by you (the “Buyer”).

  • Transfer of referral credit to any other account is not allowed.
  • Decisions made by Gotrend on these issues will be final.
